Terms of Service

1. Acceptance of Terms

By creating a YesGO account or using any part of the platform, you agree to these Terms of Service. If you are using YesGO on behalf of a company or organization, you represent that you have the authority to bind that entity to these terms.

If you do not agree to any part of these terms, you must not use the service. These terms apply to all users, including free trial users and paid subscribers.

2. Account Registration

You must provide accurate and complete information when creating your account, including a valid email address. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

You must notify us immediately of any unauthorized access to your account. We are not liable for any loss or damage resulting from your failure to maintain account security.

One individual may not create more than one personal account. Companies may create multiple accounts under a single organization, subject to plan limits.

3. Acceptable Use

You may use YesGO to create, publish, and optimize landing pages, websites, and lead capture forms for lawful purposes. You agree not to use the platform to host content that is illegal, fraudulent, defamatory, harassing, or that infringes on the intellectual property rights of others.

You may not use YesGO to send spam, distribute malware, phish for credentials, or engage in any activity that violates applicable laws or regulations. You may not attempt to reverse-engineer, decompile, or disassemble any part of the platform.

You may not resell, sublicense, or redistribute access to YesGO without a written partnership agreement. Automated access to the platform (scraping, bots) is prohibited without prior written consent.

We reserve the right to suspend or terminate accounts that violate these terms without prior notice and without refund.

4. Content Ownership

You own all content you create on YesGO, including page copy, images, forms, and configurations. We do not claim any ownership over your content.

By publishing content through YesGO, you grant us a limited license to host, display, and distribute your content solely as necessary to provide the service. This license ends when you delete your content or close your account.

You represent that you have the right to use and publish all content you create on YesGO, including any images, text, and third-party assets. You are solely responsible for ensuring your content complies with copyright, trademark, and other intellectual property laws.

5. Payment and Billing

Paid plans are billed in advance on a monthly or annual basis depending on the plan you select. All fees are in USD and are non-refundable except as required by law or as specified in our refund policy.

Annual plans include a 30-day money-back guarantee. If you cancel within the first 30 days, we will issue a full refund. After 30 days, no refunds are provided for annual plans.

We use Stripe as our payment processor. By subscribing to a paid plan, you authorize Stripe to charge your payment method on each billing cycle. Failed payments may result in account suspension after a 7-day grace period.

Prices may change with 30 days advance notice. Price changes do not affect your current billing period and will only apply to your next renewal.

6. Free Trial

New accounts receive a 7-day free trial with full access to all features of the selected plan. No credit card is required to start a trial.

At the end of the trial, your account will be downgraded to a limited free tier unless you subscribe to a paid plan. Pages published during the trial remain accessible but may lose access to premium features like A/B testing and heatmaps.

7. Cancellation

You may cancel your subscription at any time from your dashboard. Cancellation takes effect at the end of your current billing period. You will retain access to all features until that date.

After cancellation, your published pages remain live for 30 days. After 30 days, pages are unpublished and your data is deleted within 90 days as described in our Privacy Policy.

8. Service Availability

We target 99.99% uptime for all YesGO services. However, we do not guarantee uninterrupted or error-free operation. Scheduled maintenance windows will be announced at least 48 hours in advance via email and our status page.

We are not liable for any loss, damage, or inconvenience caused by service interruptions, delays, or failures beyond our reasonable control, including but not limited to internet outages, natural disasters, or third-party service failures.

9. Limitation of Liability

To the maximum extent permitted by law, YesGO and its officers, directors, employees, and affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the service.

Our total liability for any claim arising from these terms or the service is limited to the amount you paid us in the 12 months preceding the claim.

10. Intellectual Property

The YesGO platform, including its design, code, algorithms, trademarks, and logos, is owned by YesGO Inc. and protected by intellectual property laws. You may not copy, modify, or create derivative works based on the platform.

We respect the intellectual property rights of others. If you believe content on a YesGO-hosted page infringes your rights, send a DMCA takedown notice to legal@yesgo.bond with the specific URL and a description of the infringing content.

11. Dispute Resolution

These terms are governed by the laws of the State of California, United States. Any dispute arising from these terms or your use of the service will be resolved through binding arbitration in San Francisco, California, unless prohibited by applicable law.

You agree to attempt informal resolution of any dispute by contacting support@yesgo.bond before initiating formal proceedings. We will respond within 14 business days.

12. Changes to These Terms

We may update these terms from time to time. Material changes will be communicated via email or a prominent notice on the platform at least 30 days before taking effect. Your continued use of YesGO after changes take effect constitutes acceptance.
